On entend parler de plus en plus de « clause de stabilité » dans nos journaux (il ne nous semble pourtant pas que cette « clause » soit si fréquente en pratique…).
Nous allons donc revenir dans ce billet sur ce point de règlement.
La Fifa en effet, dans son règlement du statut et du transfert du joueur, qui est la « bible » pour les agents sportifs du monde entier (enfin, normalement), prévoit des « sanctions » pour la partie, club ou joueur, qui va rompre unilatéralement son contrat.
L’article 17.1 nous dit que dans tous les cas, une indemnité sera due. La partie en question devra donc payer une somme d’argent.
Ce même article 17.1 précise que cette « indemnité pour rupture de contrat est calculée conformément au droit en vigueur dans le pays concerné, aux spécificités du sport et en tenant compte de tout critère objectif inhérent au cas. Ces critères comprennent notamment la rémunération et autres avantages dus au joueur en vertu du contrat en cours et/ ou du nouveau contrat, la durée restante du contrat en cours jusqu’à cinq ans au plus, le montant de tous les frais et dépenses occasionnés ou payés par l’ancien club (amortis sur la période contractuelle) de même que la question de savoir si la rupture intervient pendant les périodes protégées ».
Le problème ne porte donc pas sur le principe de l’indemnité à verser, qui sera retenu dans tous les cas, mais sur les sanctions sportives applicables à la partie qui va rompre le contrat de son propre chef. C’est cette sanction qui va déterminer si la partie va oser, ou non, passer à l’acte : si une suspension est encourue, il est évident que le joueur, voire le club, et leurs agents, vont réfléchir à deux fois…
L’article 17.3 du règlement nous donne l’explication : « en plus de l’indemnité redevable, des sanctions sportives sont prononcées à l’encontre du joueur convaincu de rupture de contrat pendant la période protégée. Cette sanction se traduit par une suspension de quatre mois pour les matches officiels. En cas de circonstances aggravantes, la sanction est de six mois. Dans tous les cas, les sanctions sportives prennent effet à compter du début de la saison suivante du nouveau club. Une rupture unilatérale sans juste cause ou juste cause sportive si elle intervient après l’expiration de la période protégée n’entraînera pas de sanction sportive. Des mesures disciplinaires peuvent cependant être imposées en dehors de la période protégée en cas d’absence de préavis de rupture, le préavis devant être donné dans les quinze jours suivant le dernier match officiel de la saison (y compris les coupes nationales) du club auprès duquel le joueur est enregistré. La période protégée recommence lorsque lors du renouvellement du contrat, la durée du contrat précédent est prolongée ».
Avant de commenter la règle, une dernière précision : qu’est-ce que la « période protégée », selon le règlement Fifa ?
La période protégée est définie dans ce règlement comme « la période de trois saisons entières ou de trois ans – seule la période la plus courte étant retenue – suivant l’entrée en vigueur d’un contrat si le contrat en question a été conclu avant le 28ème anniversaire du professionnel, ou une période de deux saisons entières ou de deux ans – seule la période la plus courte étant retenue – suivant l’entrée en vigueur d’un contrat si le contrat en question a été conclu après le 28ème anniversaire du professionnel ».
Nous avons maintenant tous les éléments en main pour comprendre ce qu’est une “clause de stabilité”:
- admettons qu’un joueur signe un nouveau contrat dans un club. S’il est âgé de moins en 28 ans à la date de signature du contrat, la période protégée est de 3 saisons (ou 3 ans, on prend la période la plus courte). S’il est âgé de plus de 28 ans, la période protégée est de 2 saisons (ou 2 ans).
- s’il rompt de façon unilatérale pendant la période dite protégée, sans juste cause (oui, une juste cause est toujours possible, mais elle est rare : on lui paye pas son salaire, par exemple), il encourt des sanctions financière… et sportive (suspension). De ce fait, il est évident que le cas ne se présentera jamais en pratique (sauf si, éventuellement, son agent ne lit pas le règlement Fifa). Â
- en revanche, en dehors de cette période, soit après une période de 3 saisons ou de 3 ans pour les jeunes joueurs (moins de 28 ans à la signature du contrat), il est tout à fait possible d’imaginer le cas dans lequel le joueur va demander à son club de bénéficier de ce point de règlement, puisque ce dernier précise qu’aucune sanction sportive ne sera dans ce cas prononcée. Pour cela, il lui faudra respecter le préavis fixé dans le règlement, c’est-à -dire aviser son club dans les quinze jours suivant le dernier match officiel de la saison, et devra donc verser une indemnité au club quitté. Les journalistes parlent souvent dans ce cas de « racheter la ou les dernière(s) année(s) de contrat », ce qui est assez proche de la réalité, puisque, nous l’avons vu, l’indemnité sera calculée notamment en fonction des salaires restant dus. Concrètement, c’est le nouveau club qui, au final, règlera la note.
Un dernier point (rappel de l’article plus haut) : « la période protégée recommence lorsque lors du renouvellement du contrat, la durée du contrat précédent est prolongée ». Et évidemment, avec chaque nouveau contrat.
Cette « clause » est maintenant célèbre, alors qu’elle existe depuis de nombreuses années. Mais, dans les faits, elle n’est pas du tout conseillée par les agents, sauf grave conflit avec le club.
